Staver Founder and Chairman 2/27/2014 In the past 18 months, Boston Children’s Hospital (BCH) and the Massachusetts Department of Children and Families (DCF) have removed at least five children from their homes, making them “wards of the state.” One pediatric physician cynically coined the process to be a “parent-ectomy.” Please see my important update below on the plight of Justina Pelletier and the Pelletier family, and take a moment to listen to my audio update – Mat. Pearl, The idea of a medical facility removing a child from a loving family – a family in which there is no history or evidence of abuse of any kind – is a chilling thought. The Pelletier family’s legal ordeal in Massachusetts is just such a story of abuse by Big Brother. A little over a year ago, Justina’s parents, Lou and Linda Pelletier took her to Boston Children’s Hospital (BCH) for flu-like symptoms to see a gastroenterologist recommended by Tufts Medical Center, the hospital where Justina’s primary care physicians are located. Justina had been diagnosed with a rare medical disorder at Tufts. Her condition took Tufts months to isolate and identify, which is common for this specific disorder. When Justina’s condition took a turn which required the attention of a gastroenterologist, the Tufts team referred her to a specialist at Boston Children’s Hospital (BCH). Instead of allowing Justina access to the specialist, a BCH intern came up with a change to her Tufts diagnosis in a matter of hours! The intern deemed her condition to be mental, not physical. Justina was then barred from seeing the gastroenterologist. ++Parental rights swept aside. Lou and Linda Pelletier disagreed with the intern’s rapid diagnosis. Their decision was to remove Justina from BCH and to take her back to Tufts Medical Center. But BCH refused to allow the Pelletiers to leave with Justina. That’s when the Massachusetts Department of Children and Families seized her with armed security. They charged the Pelletiers with medical abuse for following the counsel of their “other” physicians! Under DCF’s “care,” Justina’s health has deteriorated to a dangerous state. In the DCF facility, Justina is also refused services from either clergy or educators. Further, the restrictions on visitation on Justina’s family have been extreme – they are allowed just one hour per week and then only under supervision by DCF agents and the Massachusetts State Police. The Pelletiers were also told they are under an alleged “gag order” by the court with jurisdiction, which is an unconstitutional abridgement of their First Amendment rights. ++Liberty Counsel’s legal team is working on behalf of the Pelletier family. I first learned of this case last week when Lou Pelletier broke the so-called “gag order” and took his family’s case to the media. Lou has subsequently been charged by the DCF for contempt of court. After an investigation of our own, the Liberty Counsel legal team began working with the Pelletier family to defend their freedom of speech and to assist in the return of Justina to her family and home. We are particularly concerned that she immediately receives the medical care her disorder requires. We are exhausting all legal means to get this done in a timely manner before Justina’s health deteriorates any further. There is much more to this story, so I have recorded an exclusive audio message, which contains details of the Pelletier’s plight that I can’t write in this brief message. There are more questions than answers right now, but two things are certain: A young woman’s life hangs in the balance because of an intern’s rapid misdiagnosis followed by the “parent-ectomy” by BCH and the Massachusetts DCF. A family is in extreme emotional distress fighting against the overreach of a powerful state agency which has arrogantly declared that they know better than the parents and another highly skilled medical team at a renowned facility.
