How do I go about getting my Fathers,medical, Fiduciary and Mesothelioma Claim investigated? On June 14, 2012, I put in a complaint for Inquiry Routing & Information System, Reference # 120612-001170. On My father Ralph Herbert Trammells behest and our family, Fiduciary, Phyllis McLennan of Waco, Texas and Her Attorney, John Malone of Temple, for Fraud and taking my Constitutional Rights away from me concerning the custody of my Father. John Malone wasnt hired by the VA, he was hired by Ms. Phyllis McLennan. He was conducting legal issues on my father’s case as a FAVOR FOR PHYLLIS MCLENNAN! I asked him why he was doing a favor for Phyllis McLennan, and he never answered that question. I asked John Malone why it took so long to contact me, and why wasnt a certified letter that he was distributing my fathers benefits to whoever? Why wasnt a certified letter sent to my address that I have lived at for 6 years? John Malone got very irate and told me he didnt have to answer my questions. He was very rude and unprofessional. This was an in person visit to Mr. Malones office. I gave him the information to contact my siblings at the time. All this information was missing from my father’s file. I had my siblings address’s updated when my father was put into my custody. The Field examiner, Honorio Taguinodas was very unprofessional when interchanging with my father. My Father did not want that man in his house and was very upset with Honorio Taguinodas for the manner which he spoke and treated my Father. He made my father feel very ashamed for me having to take care of him and talked down to my Father. I tried to get a different Field Examiner for my father and I was denied. On June 18, 2005, my Father received a letter from Dept. of VA in his own name, instead of it being addressed to me as his custodian, and authorized as his executor by power of attorney by Mr Ralph Herbert Trammell. The letter states that on June 22, 2004, Phyllis McLennan would be my Fathers “A Successor Payee” and that Honorio Taguinod had “instructed” Phyllis McLennan (not APPOINTED by the Texas Courts) to issue $600.00 for room and board and $200.00 for my father’s monthly spending allowance. It also stated that Phyllis McLennan would get 4% monthly commission for her assistance. The letter was signed by Jan Bartee, who works for Sande Jones-Veterans Service Center Manager. This was NOT done or signed legally by Sande Jones. We were never given the RIGHT to appoint my father’s Attorney, Marvin Johnson, as my dads Fiduciary. Our Rights were abused and taken away for due process of his desires and wishes. Then I, Valerie Trammell, called the Waco Regional Office, speaking to Jan Bartee, to find out how this could of happen without going to COURT and to how to get Marvin Johnson appointed as my Fathers Fiduciary. Jan Bartee answered my call for the Fiduciary department. When I asked her how Phyllis McLennan got appointed without any involvement of myself in Court or any legal proceedings whatsoever. She said, They didnt have to go to court since MY MOTHER called and THEY talked to her. That MY MOTHER told them to appoint Phyllis McLennan as my father’s Fiduciary. My MOTHER has been DEAD since December of 1989! When I told Jan Bartee this and asked her for her SUPERVISOR the phone call went DEAD. How would my mother know Phyllis McLennan since my mother was deceased in 1989. I have reported my Complaint on my Fathers treatment by the VA workers and his VA Doctors. On Oct. 29, 2012, I made my Complaint on Doctor Napoleon Mayorga & Nand L. Mehta on Nov. 12, 2012, File# 13-1221 through Texas State Medical Board and they will not do anything about my complaint. I have put in numerous complaints to the VA in Waco and Temple, Texas. I have never heard anything back from any of the Facilities. My Father passed in 2006. Before His passing, his Fiduciary lied and the VA took away my rights illegally. The fiduciary lied about talking to my Mother. My Mother has been deceased since December 28, 1989. I took care of my Father from 2001-2006. There is NO WAY they talked to my MOTHER. My father had surgery in 1989 and was introduced with radiation pellets for treatment. I am now going through Medical problems of my own, through, what I believe is exposure to the same elements that my father was exposed, by direct contact to him and his clothing and environment as a military family member, and need this information that I have requested concerning my fathers medical records, and I have been denied from the VA & the State of Texas concerning Mesothelioma. I have repeatedly been reporting my complaints. I even contacted Mr. Steve Hernandez that works at One Stop Vet., Waco, Texas. He has told me they have been getting overwhelmed with many complaints about the VA appointed Fiduciaries. Phyllis McLennan was my Fathers and John Malone is the Attorney that was in charge of my father’s estate that I was told by Mr. Malone he was doing it as a favor for Phyllis McLennan. This was entirely done with NO Veterans Administration knowledge. If it was not done in the legal manner. I had to constantly call the VA and Phyllis McLennan’s home # and Phyllis told me she didn’t work for me so she didnt have to talk to me. So then I contacted the VA Fiduciaries Dept. and was told to put in my COMPLAINT on Phyllis McLellan. I have done so with no response from anyone. Where was my father’s monies and what happen to the interest rate on these funds? Why were my rights taken away? I couldnt even get any information on His Mesothelioma Cancer. The VA didnt even give me or My Father, OUR RIGHTS to the option of handing over my Fathers affairs to Our Family Attorney, Marvin Johnson from Phoenix, AZ... Why are our rights taken away? Even Scott & White Hospital of Temple, who had My Fathers medical records, not able to disclose these mentioned records to the lawful heirs to those records. He has never been seen at Scott & White. His RIGHTS, as well as the HIPPA Law covering his records, was violated, and no one would help me get my father’s records back from Scott & White. I tried to start a Mesothelioma claim through the help of the Disabled American Veterans Office in both the Temple & Waco Offices of the Disabled American Veterans Offices, and was again DENIED. The DAV told me there was no evidence of my Father having CANCER. I feel my Family has been treated unfairly and there is an issue in my Fathers case! I still cannot receive my Fathers autopsy report from the VA stating that he has Mesothelioma! They continue to deny me. I have tried many of times to getting a copy from the VA stating my Fathers Cancer. I have been DENIED. Doctors Metha & Maygora lied to my Father about his Cancer and that they stated to me & My Father that he didnt have Cancer. The Nurse on duty that day helping with my Fathers Doctor visit, asked me to follow her to her office and there she wrote down what was wrong with My Father and it stated CARCINOMA”. I am now having test done AGAIN for My CANCER! I feel that my RIGHTS have been taken away from myself, my Father & My Family. I even sent my complaint to VA Inspector General Hotline on March 14, 2013 to have Open Records on this case and March 19, 2013, I was DENIED! The letter states that I need to put my Complaint into the VA Regional office in WACO, TEXAS. That’s where I started in the first place. The DAV office would not even help me. The DAV has the record of when I tried to get my Dad seen for Mesothelioma and the DAV denied me any help. As Veterans Family Member & an AMERICAN CITIZEN The United States Veterans Affairs has violated MY Constitutional RIGHTS!
