How do I prove that I am the one and the same person? - Notary Certificate or statutory declaration to prove your identity As a leading provider of notary public services across Sydney, we are frequently asked to help our clients prove that they are the ‘one and the same person’ for overseas. Often this need arises if they have property or business dealings in another country, and in that country they use a different name or rely on a different form of identification. Sometimes the form of identification used in that other country may have expired without being renewed or considered invalid because they haven since taken up Australian citizenship and renounced or are not entitled to retain dual citizenship. Whatever the case may be, there is some inconsistency that must be clarified before they can move forward with their property or business dealings – and they come to us for help. How can a notary public help you? If you find yourself in this situation, depending on the intended destination country or the situation/purpose that you are facing, you might be able to find an existing processes to follow or relevant documents and forms to complete and sign. Since you will probably sign those documents or forms in Australia but send them overseas, you will need to have them witnessed and notarised by a notary public (as well as follow any other formal process such as authentication and legalisation, or stamping with an apostille). That is what we do. Although we cannot provide you with specific advice regarding the processes, documents or forms that would be valid in any specific country (even if we are familiar with them, this is advice that you must obtain from the relevant person in the intended destination country), our role is predominantly to confirm that you are the person who has signed them – and for that purpose we identify you. If there is inconsistency with another form of identification, but we are satisfied that it is still you we can provide that confirmation as well. You are you, and you are the one and the same person. Even if there is no pre-existing process, document or form (or you are just not aware of it), we can still assist you in preparing a statutory declaration or a notary certificate to prove your identity, especially to confirm that you are the one and the same person. The statutory declaration or notary certificate will also need to be witness or signed by a notary public and be authenticated, legalised or stamped with an apostille. What is the difference between a notary certificate and statutory declaration for identification? A notary certificate for identification purposes is certification by a notary public that you are who you say you are and who you can to be – and if necessary, that you are the one and the same person. This means that you will need to prove your identity to that notary public and satisfy them that you are the one and the same person. A statutory declaration for identification purposes is your declaration that you are who you say you are and that you are the one and the same person. Whether you need a notary certificate or must make a statutory declaration depends on whoever requires you to provide this evidence. What do I need to bring to prove that I am the one and the same person? For us to assist you with notarising your statutory declaration or to prepare a notary certificate, you must attend our office in person and bring your original photographic identification documents – generally being your current passport as well as any other previous passport or photographic identification document that is relevant to your ‘other’ identity. Once we are satisfied that you are who you say you are, that the identification documents you produce support your identity, we will then be able to notarise your statutory declaration or provide you with a notary certificate – as well as confirm that you are the one and the same person.
