How long does the average divorce take? By Camy B. How long does the average divorce take is a very common question asked at a consultation; however, it is not the same answer for every potential client. A divorce, or dissolution, is very case specific, and fact specific. Two different families with a house and each having three (3) children does not mean the case will take the same amount of time, because the facts are similar. If one has a truly uncontested divorce (no children, no real property, no assets) this can take one (1) month if both of the parties act diligently in providing the necessary information and documentation to one another or to their attorneys. From the date of filing the Petition for Dissolution of Marriage (more commonly known as divorce papers) the Court will not enter a Final Judgment prior to the twenty-first (21st) day. If there is property (real or personal) to be divided, or debts, a Martial Settlement Agreement is required in most Florida jurisdictions. IF there are minor children involved a parenting plan and a parenting class is required in the state of Florida. IF the parties are contesting any issues or there is a significant amount of discovery (review of documentation) to be done, this can increase the time the case can take to resolve. If there is the need for any court hearings, the Judges calendar (docket) may be booked out for months. If a trial is required, this will create the need for trial preparation, which may include subpoenas (they usually have a 30 day turnaround time), depositions, and preliminary pre-trial motions.
