I HAVE COME TO TAKE OVER......... ATTORNEY-GENERAL The Rivers State Commissioner for Justice and Attorney-General Mr. Worgu Boms said he has come to take over the matter between the leader of the House of Assembly Hon. Chidi Lloyd and the police Commissioner. Mr. Worgu Boms, said this at the High Court, Port Harccourt recently when the House Leader, Hon. Chidi Llody appeared in court for attempted murder, malicious damage, amongst others. He said the counsel to the police Mr. Donald C. Denwigwe has failed to recognize the ethics of legal Practition and also claimed to be right in his argument. According to him, section 211 Subsection 1, paragraph B and C of the 1999 Constitution as amended granted him the right of taking over any matter within his domain. The counsel to Chidi Llody, Mr. Beluolisa Nwofor (SAN) submitted that the police is an institution, that Mr. Donald C. DENwigwe (SAN) is a private practitioner and was not in any way mentioned in the suit or motion filed before the trial judge. Mr. Nwofor added that under the ethics of legal practice, a lawyer is not permitted to stand in for any institution without obtaining a fiat from the Commissioner of Justice and Hon. Attorney-General of the State where such crime is committed. Responding, the counsel to the police, Mr. Donald C. DENwigwe (SAN) said that with the provision of the Police Act anybody can represent the police. The trial judge, Hon. Justice L.L. Nyordee therefore, adjourned the matter to August 6, 2013 for ruling if DENwigwe private lawyer has the right to prosecute without obtaining a fiat from the Attorney-General of the State.
