UPON hearing the counsel the Court made the following O R D E R We have heard Mr. Sanjiv Sen, learned senior counsel appearing for NDMC-Respondent no. 2. He has stated that a reply affidavit giving certain particulars with regard to the widening of the approach road from Bhagwan Dass Road to Gate C and Gate D of the Supreme Court of India building has been filed. However, the work can be undertaken for widening of Gate C and Gate D by the CPWD/PWD. They have no objection with regard to the widening of the gates. He has given suggestion for parking of additional vehicles by constructing parking ramps along the Supreme Court boundary wall and north side carriage way of Bhagwan Dass Road. He further submitted that NDMC is willing to extend all professional assistance towards furtherance of any task in this regard and for the traffic management and parking in and around the Supreme Court Complex falling within the jurisdiction of NDMC. The aforesaid proposals may be examined by all concerned/stakeholders. Mr. P.H. Parekh, learned senior counsel representing SCBA submitted that there is some vacant place by the side of the ITPO which was being used by the advocates for parking their vehicles. He has invited our attention to the letter dated 05.03.2012 written by Mr. Harin P. Raval, the then Additional Solicitor-General of India addressed to the President of SCBA informing that the earlier usage of that place by the advocates for parking the vehicles has been unilaterally withdrawn by the ITPO. Mr. Ravi Sikri, learned senior counsel appearing for ITPO-Respondent No. 4, is present before this Court. Upon being asked about their legal right upon the aforesaid vacant land he has categorically made statement at the Bar that they do not have any interest whatsoever in the said land but the usage of that place by the advocates has been withdrawn in there interest of public as during the time of National and International fairs conducted by it, there is large influx of people as well as vehicles and they have to facilitate the smooth flow of visitors and parking of their vehicles. In that scenario, if the advocates are allowed to park their vehicles at the aforesaid place then it would cause traffic hazard to the smooth and free movement of the traffic and visitors. Mr.Ranjit Kumar, learned Solicitor General appearing for the Union of India-Respondent No.1, submitted that since the vacant property belonged to the Ministry of Urban Development of the Central Government, he seeks time to put up the proposal to the concerned Ministry and take necessary permission with regard to the exigency and requirement of parking of vehicles of the advocates in the aforesaid area which is vacant and available at present. He further submitted that he would write to the Urban Development Ministry and the Delhi Police for the purpose of regulating the traffic movement and parking of the vehicles of the advocates in and around the Supreme Court Building during peak hours and routine hours. His submission is placed on record. He is requested to take necessary permission in this regard from all the concerned departments. List the matter on 18.12.2014 as Item No. 1 for this purpose and for passing appropriate order.
