I am not trained in law, But reading the constitution I would say that policies used by DHS and perhaps the act that created it violate Article 1- Section 9 . Specifically the prohibitions against suspending the right of Habeas Corpus, and DIRECTLY violate the prohibition of passing laws containing bills of attainder - Which implies that even in cases of TREASON the defendant retains his rights ... to Trial / witnesses for defense / facing the accuser - et cetera ! - Therefore the draconian practices contained in the patriot act and the procedures of the DHS are demonstrably unconstitutional and should be voided entirely.
