I can’t comment on the copy-cat cases you have sighted but would highlight another very famous story of Ben & Jerry’s vs. Haagen-Dazs - perhaps we can all learn lesson from their story. Round 1 • In 1984 big business came after the little boys! • Haagen-Dazs tried to limit distribution of Ben & Jerry’s in Boston • They gave Ben & Jerry’s an ultimatum: “Sell Haagen-Dazs or sell Ben & Jerry’s ……..not both” Round 2 This prompted Ben & Jerry’s to launch the now famous “What’s the Doughboy Afraid of” campaign - Placing adverts on the side of buses - Renting banners on planes - Taking out classified ads in the Rolling Stone Magazine - Asking readers to help fight the Pillsbury Corporation Round 3 In 1887 Haagen-Dazs again tried a 2nd lawsuit – but failed! As a direct result of all the bad press Haagen-Dazs (Pillsbury Corporation) had to renege on its ultimatum!
