I en sak mot Østerrike ( Bakker v. Østerrike (2003) sier Den Europeiske Menneskerettsdomstolen: The Court observes at the outset that the administrative authorities, the Regional Governor and the Ministry for Health and Consumer Protection, are not “tribunals” within the meaning of Article 6. I saken mellom Van Der Hurk og Nederland, ble det konstatert krenkelse fordi Van Der Hurks rettigheter ikke var avgjort av en ”tribunal”, ref premiss 55: ”There has accordingly been a violation of Article 6 para. 1 (art. 6-1) in that the applicant’s civil rights and obligations were not determined by a tribunal. Med andre ord har ikke administrative organer (Fylkesnemnda, Trygderetten m.m) kompetanse til å utføre inngrep som berører den ankende parts menneskerettigheter. Det er det kun domstolen som kan gjøre.
