It is surprising that you have stood out for the police officer and joined forces against those who requested action at the scene. Paramount duty of a defence officer is to act in defence of the nation; duty of the doctor is to act in interest of the patient and for the police officer to act in the interest of the society. Hippocratic, Duty honour country and all other sacred oaths teach action, initiative and judgement on the spot, the essence is to inculcate commitment to acting in ways which will promote the well-being of people and not to resorting to ‘throwing the rule book on the face’. You have applauded inaction, indifference, insubordination and encouraged hostile and arrogant act of indiscipline by a public servant. You have conferred hero status on the ACP and gone to the extent of saluting him. Sir, I think you seriously need to revisit the concept and definition of a hero. As per the Air Force standing orders, airfield under attack is not to be used. During the 1971 war Srinagar air field was attacked by six Pakistan Air Force F-86 jets. Flying Officer Sekhon was on readiness duty at that time. Under heavy fire, he defied orders took off in his Gnat and engaged the Sabres. He was able to beat back the attack but lost his life in the process, even his corpse was never found. Our grateful nation awarded him PVC. Similarly it is not the duty of a doctor to go into the line of fire, nor of a journalist to stand in the face of active battle. Such exceptional deeds of kindness, selflessness, physical prowess and great courage by overcoming enormous obstacles are recognized as acts of heroism. These actions invariably extend beyond the normal call of duty. Such are the deeds that inspire others and are classified as acts of valor and heroism and entitled to respect, honor and recognition by a salute. Actions of the police officer in question are contrary to all the above attributes, in fact he did not even want to perform his duty. Sir you are a know, seasoned and renowned lawyer surely with a matching fees. Law is a term, a system of rules and guidelines which are enforced through social institutions to govern behavior. Civil society is necessarily the source of law, by being the fundamental basis of opinions and belief for what law should be, as Max Weber has famously argued “the state is that which controls the monopoly on the legitimate use of force”. The military and police carry out enforcement at the request of the government or the courts. The Law minister is part of the government an elected member of the legislature with inherent and legitimate authority. The president of India is supreme commander of the armed forces but the army chief does not refuse orders of the Defence minister. Please introspect on your advocacy of defiance by the police officer, it is coloured and biased showing you to be a paid lawyer not a statesman. To buttress you view you have cited a celebrated British judge but an equally celebrated judge of Supreme court of India has written that “Police are dacoits in khakis”, I am sure you would not like to leave you money or an unescorted female family member in the police station. Postings of SHOs are auctioned, areas with more brothels and drug dens like Pahargang or land issues, invite highest bids. The beat constables are extortion agents with monthly collection targets, commercial vehicles vans carrying school children pay bribe based on number of traffic signals on the route, forcing the vans to carry additional children. Even out of the pollution check charge a percentage is collected by the traffic police. You seem to feign ignorance to all this. You are a learned and renowned lawyer and senior politician but your stand in current case reveals that you are quite willing to use you ‘Gyan’ to suit you convenience rather than the good of the society which is your moral duty. You seem to have joined the ranks of other learned lawyers P Chidambram, Kapil Sibal, Abhishek Singhvi and Manish Tiwari who are now more famous for their stupendously skewed interpretations of public loss during scams, electoral cunning, moral turpitude and Caesarian declamation in self interest respectively and constitute the LLCA, ‘Learned legal luminaries with crooked attitude’ Club).
