I had a public defender in Los Angeles tell me he thought that I should not have been retained because I know how to work the system, and you dont. ...[BREATH IN...exhale slowly] ... Now, Sun Tzu teaches to appear weak when you are strong, and strong when you are weak, so I politely shook my head and after a moment I asked, assuming I didnt come into the case, would you have done the hearing full knowing he cannot win it? He said, ummm...well, yes. I asked, why? and he responded, umm...well sometimes you need to go down fighting kicking and screaming. ...[BREATH IN...exhale slowly] .. In my head, I know of about 4 motions to file which could substantially alter the outcome to potentially a time served sentence. Instead of telling him even of 1 potential motion, or asking why he didnt file it, I apologized because he appeared to be irritated and I said, Im sorry if I upset you. I cant imagine why I did, but sorry nonetheless. In response, this guy asks me if I want to step outside! Again, I politely shake my head a walk away while the judge rolls her eyes giving me the tell me about it look. THEN the PD refers to himself as court staff and that I shouldnt be rude to the court staff. WOW!!! Here I thought he was the only thing standing between iron bars and my client. Moral? IF YOU ARE CHARGED WITH A SERIOUS CRIME, DO NOT USE THE PUBLIC DEFENDER UNLESS ABSOLUTELY NECESSARY.
