I have attached the mediated agreement from the Council of Review petition that was filed by John Burns et al on May 8th. We spent over six hours in dialogue to reach a grand agreement that addressed the petitions direct concerns and some issues that were outside of the scope of the petition in an effort to move the party toward unity and a focus on winning elections. As you all know at our SEC meeting in August we will be addressing the Plan of Organization. The Plan with either be amended and/or completely revised. To that end the attached agreement addresses the ambiguity in our current plan regarding 1) the appointment of an Interim Executive Director and 2) the number of sustaining fund co-chairs that can be appointed as voting members of the executive committee as well as serve on the executive committee as ex-officio members and thus participate in the meetings and discussions. These members will be able to participate, but they cannot vote. I believe this will move us forward in the spirit of what I wanted to accomplish with the sustaining fund co-chairs, while acknowledging the concerns raised by the 11th Congressional Chair Luke Hyde and others. Item 3) deals with contracts. Our new Executive Director, Robert Dempsey, is continuing the work of the Internal Audit and Best Management Practices Committee (IRBP) which was appointed in part to review contracts and procedures for the best management practices of the NCDP. As with other agreements, the contracts with the Agema Group and C & C will be given a notice of termination. All contractors will be invited to resubmit bids and when required and/or needed the executive council will play a role in the process as well. Item 4) Mr. Burns asked if I would be willing to replace Mr. Franklin as one of my at-large appointments on the executive council that he considered would be a move toward party unity. I said I would consider asking Mr. Franklin to do so as a statesmanlike expression of party unity on the condition that such an action would result in the officers issuing a joint endorsement of Item 6) below. (Unity) It was not possible on Saturday the 15th to reach Zack Hawkins, Andy Ball and Melvin Williams, but we stuck with the negotiation anyway in the sincere hope that an executed agreement that shows good faith by all parties will bring everyone on board with a unified front. In any case, Mr. Franklin will still be serving as the co-chair of the (IRBP) Committee and as an SEC member from Alamance County. He is strong advocate for democratic principles as well as the Senior Democrats and he deserves kudos for his willingness to make a selfless move in an effort to support unity in the party. Item 5) We all agreed that it is a good idea to continue to seek as wide an audience as possible for input and to constantly communicate to our leaders and our base. Item 6) This is a very important element of the agreement to me and is a clear signal for us to move toward unity, fight the Republicans, and win elections. I call on all Democrats to endorse item #6 and move forward with strength and vigor. Onward and Upward!
