I have been asked lately about release forms and such so I thought I would share some information to all (clients, models, photographers) This is all just for knowledge purposes :) Get ready for a long read everyone :) Release Forms (most commonly model release forms) are signed by models or clients so that the Photographer has rights to sell the images to others. Release Forms are more for commercial purposes. If there is no release form signed, the photographer has no right to sell the photos for commercial purposes. For my business, I do not sell your photos to other people or companies so I do not have these forms lol :) I do portrait photography for families and the images go to you and only you :) Release Forms are not given to state you are allowing the photographer to take photos of you. Not having a release form does not mean that a photographer does not own your images. A person does not have "rights" to himself/herself when it comes to photographs. Just because you are in the photo does not mean you own the photo :) For Photographers, you can photograph anybody who’s is in public view and doing anything not considered private and you own these photos This is considered legal photography. Creation of the photographs rest with the photographer (capturing, editing, etc.). The photographer has the copyright to these photos and this is protected by law. The photographer very easily proves that in court with the original images and their work etc. I hope none of you have to bring any issue to court with any photographer lol :) Now for clients and models..once you get these images on a disc or print, the copyright still belongs to the photographer. You do not own copyright over these images and may not sell these for commercial purposes. This is why photographers give you print releases stating that you may print for personal purposes. In addition, it is copyright infringement to edit, crop, modify/alter these images in any way :)
