I have been charged with violating a protective order x 4. I was brainless and texted my wife. What is the Penalty for Violation of a Protective Order in VA? Violation of a Protective Order is a Class 1 Misdemeanor, which has a maximum penalty of up to 1 year in jail and a fine of $2500. If you are found guilty, you will have an additional protective order against you for up to 2 additional years. According to the court I am facing up to four years in jail for sending non-threatening, and informational messages to my wife about taxes, my children, and the pending divorce. I was arrested the day before my c & p examination for the VA, so I still have not been able to see a doctor. It has been over a year. I want the world to know that if I am found guilty of these frivolous charges, my future will be severly impacted. I have already told the judge that I texted my wife informationally because they granted a one-year restraining order in my absence at court. Apparently I have no basis to ask for a divorce or press issues because I have a restraining order on me. I plan to plead not guilty to this criminal charge. I am not a criminal. I have not been allowed to speak to my children since July, even with repeated asking. Im trying my best. I need a divorce lawyer to help me but I am broke.
