I have been thinking a lot about a conversation with Duane King, an attorney in DC, who said that the best way to address the injustice and racial disparity happening in our court systems is to use professional juries as opposed to a jury of our peers. I thought he was wrong, I was hopeful that we could educate our peers to do a better job. But how do I educate someone who shows up for jury duty sharing the views of the guy who blew away 3 people, thinking they were Jewish? How do I educate someone who participates in separatist activities who might show up to sit on a jury for a young black man accused of a minor crime? Are professional juries the best way to go to level the playing field? It makes sense, they would have a solid knowledge of the law, and perhaps more parity (less racially biased verdicts, less emotional verdicts, have a better understanding of monetary awards, etc.) Any thoughts on this?
