I have just hit a snag. This is a little hard to explain. On Thursday, Judge Ovrom ordered the state to file the administrative record in my case against the Iowa Board of Pharmacy. The problem is that the administrative record I claimed in my petition to the board is everything that was filed between 2008 and 2013, which is thousands of pages of medical and scientific information. Ive contacted the state and asked them if we can agree that none of that evidence is relevant to my appeal. If the state does not agree, then I have no choice but to dismiss my appeal before I get hit with a bill I cant pay. The new petition I filed last month is similar to the one I filed in 2008, it has no scientific or medical information. My new petition just has two legal arguments: (1) the board is obligated to recommend reclassification annually unless facts have changed showing marijuana no longer has accepted medical use in treatment in the United States; and (2) marijuana has accepted medical use in treatment in the United States as a matter of law because its accepted in 34 states and DC. Its not easy suing the state executive branch for failure to perform its role in advising the state legislature.
