I have written my NC State legislators in regards to changing the wording of the littering law to include grass clippings. look up your particular legislator in the NC House and Senate at ncleg.net/representation/WhoRepresentsMe.aspx I am also encouraging each post on social media to also include the hashtag #NCGA which will also show the post on the NC General Assembly social media page, thus showing the entire NC General Assembly that we are making this a matter of importance. You can use the following template as a format for your email or letter to your Legislator. Please feel free to pass this on: I am writing to you, (insert your legislators names here) , my legislators as I have found you both to be according to the ncleg.net website. As a resident of (Your) County in (Your City), NC. I am writing in regards to having the NCGS 14-399 adjusted to more clearly define Grass Clippings as litter by making the following change as added to the current bill as shown in the below text. NCGS 14-399 (i)(4) "Litter" means any garbage, rubbish, trash, refuse, can, bottle, box, container, wrapper, paper, paper product, tire, appliance, mechanical equipment or part, building or construction material, tool, machinery, wood, motor vehicle or motor vehicle part, vessel, aircraft, farm machinery or equipment, sludge from a waste treatment facility, water supply treatment plant, or air pollution control facility, dead animal, GRASS CLIPPINGS or discarded material in any form resulting from domestic, industrial, commercial, mining, agricultural, or governmental operations. While being used for or distributed in accordance with their intended uses, "litter" does not include political pamphlets, handbills, religious tracts, newspapers, and other similar printed materials the unsolicited distribution of which is protected by the Constitution of the United States or the Constitution of North Carolina. My first point: Grass clippings thrown from a mower into the roadway is dangerous. North Carolina is a beautiful state and has many miles of roads that are travelled quite frequently by cars and motorcyclists. I know of several people that are now deceased or disabled because of accidents they have had because of grass thrown into the roadway. Now it may be up to interpretation of the law, but according to GS 14-399 (h), if I am injured due to someone’s negligence in throwing grass clippings (litter / discarded material) in the road then the homeowner or landscape service, or whoever is responsible for throwing the grass clippings into the roadway, can and should be held liable for all damages, up to threefold, arising out of their own carelessness and negligence. However there have been too many times that State Highway Patrol writes it up as the riders fault and never charges the persons that created the road hazard. By adding the wording of grass clippings to the current law, it would offer an additional level of safety. My second point: Grass clippings will fly up off the road and get into the radiator of a vehicle. This may not seem like a big deal, but given the fact that grass clippings can prevent sufficient air from getting through the radiator cooling fins, thus raising the temperature of the engine, and therefore reducing the overall life of an engine in a vehicle. Costing taxpayers more of their hard earned income I am sincerely hoping that you, as my representatives, will consider this simple addition to a already in place law.
