I havent had time to read the Hobby Lobby briefs, but I will offer my uninformed opinion anyway. Didnt the Court in 2012 find the ACA individual mandate to be an effective tax? Wouldnt the employer mandate be subject to the same logic? Taxpayers almost never have standing to challenge appropriations of tax dollars. The reason for this is not complicated: we have a democratic republic that would grind to a halt if every person who disagreed with a certain allocation could be exempted from having to pay for it. Also, it seems the government shot itself in the foot when it granted exemptions for non-profits in the first place.
