I just finished reading todays entire court decision and was actually quite impressed, especially considering it was written so quickly. Summary: Granting interim order requires two things - high likelihood of ultimate victory and balancing of harms done to each party by granting/not granting interim order. Regarding first point - considering citys inappropriate actions, there is indeed reasonably high likelihood of ultimate success of ministry. However, harm to ministry caused by it being disregarded in this manner by city and harm to Safot v Tarbuyot caused by presence of guest classes for the few weeks until final decision and/or Mishkenot Daat actually closes down completely (which is currently scheduled to happen in less than 30 days) outweighed by immediate harm that would be suffered by students of Mishkenot Daat were they to be kicked out today. The court stressed that Mishkenot is to behave as a guest and that there are to be no dividing walls whatsoever, inside or outside.
