I know many of you are worried about the VAT rule change but did many of you know about and conform to the new EU laws on website cookies? Loads of website are in breach of this and it has been in force since 2012. And it affects every website in the world that is viewed by an EU person. Again most people in the US dont feel that applies to them so you do not see any warnings about cookies on their sites. x3internetsolutions/eu-cookie-law-p-30.html The reason I am bringing this up is this caused the same issues with interpreting the actual laws. The laws state that you must obtain permission from the person BEFORE placing cookies on their machine. In the real world you just cannot do this as most website software drops a cookie as soon as the page loads. Plus most websites have 3rd party plugins for adverts which also drop cookies. So in real terms you cannot stop cookies being placed. In consultation with the relevant authorities it was deemed acceptable that if you warn them that your site uses cookies then it is enough proof that you have complied. This brings me onto the 2 form of proof needed. The developers circle are saying that using GeoIP Country location for the IP address and matching it with the country entered as there billing address is proof if they match. If they dont match then you can refuse checkout or some are giving a checkbox for self certification from the customer that their billing address is correct. That self certification is then stored along with the other details. Take a look at this wordpress plugin to see how they are doing it. I dont expect any issues with this way of doing things as you have proved that you are doing your utmost to provide and keep the data within the spirit of the law and what is actually available to you. lyquidity/wpstore/downloads/eu-vat-support-for-edd/ Capturing evidence The VAT plugin will allow you to collect the billing address, and so the country, of the purchaser and the IP address of the browser and so a second piece of evidence about the country of the purchaser. Validating evidence The plugin will compare the country of the billing address and country of the IP address to confirm they are the same. In this way you have the two required pieces of evidence. If the countries do not match the buyer will be prompted to confirm the country of the billing address is the correct location of supply. The confirmation, known as self-verification, is also recorded and constitutes the alternative second piece of evidence.
