I like to draw your kind attention to the fact that I am an established entrepreneur and having a number of vehicles used for my business purpose. Generally, most of these vehicles are of Mahindra & Mahindra make. However, on January, 2012 I decided to purchase a new vehicle when many of my close associates advised me to purchase Volkswagen. Keeping in mind of this reputed German concern, I ultimately bought a Volkswagen Polo on 5th March, 2012 from M/s OSL Exclusive Pvt. Ltd. having their office at 3A, Rammohan Mullick Garden Lane, Kolkata -700010 bearing Engine No. CFW224080and Chassis No.WVWL1160XCT019343. I had a nice and comfortable ride in the vehicle for last one year but unfortunately the car met with an accident on 19.06.13. After lodging FIR to the Police Station the vehicle was sent to Volkswagen authorised Service Station at Gopalpur, Sarkarpool, Budge Budge Trunk Road, Mahestala, Kolkata – 700143. The matter was also informed to Reliance General Insurance Company Ltd with whom the vehicle is insured. After a prolonged persuasion and repeated reminder the vehicle was delivered to me on 17th July, 2013 (approximately after a month) with due approval of the surveyor of the insurance company and payment of bill by us for Rs. 45,077/- . The reason for this undue delay from the workshop was unavailability of spares as explained to me. Inspite of that, though as promised, no loan car was given to be during this period. However, on the next morning when the vehicle was taken out for my official duty it was observed by my driver that there was a continuous leakage of oil from the gearbox. This matter was immediately brought to the notice of the workshop and insurance company. The vehicle was again sent to the workshop and on inspection the workshop officials informed us that this leakage is due to a further accident though I am confident nothing such happened in between. However, when the insurance surveyor inspected they also dispelled the case of further accident and refused to acknowledge any claim. I thereafter took a leading automobile engineer having a workshop and looking after all my remaining vehicles for inspecting the vehicle at Volkswagen garage. On thorough inspection he was also of the opinion that this fault is not due to any further accident. Had it been an accident the chamber on which the gearbox is placed would have been heavily damaged. The surveyor of insurance Co has all the photographs of the gearbox from different angles. If required the said photographs can be posted. Under the situation, I am at confusion whether this fault is due to defect in the gearbox itself or the box had been damaged or replaced by the workshop. Any of this one can damage the reputation of your worldwide organization. I shall be thankful if you kindly advise me regarding my next course of action.
