I must confess that I hate Affirmative Action. Ive never liked or supported it from the onset. Id never have applied for nor accepted any position where I would have been referred to as an affirmative action appointee. I may be poor and uneducated. But my dignity trumps all those things. Forget about the likes of Ellen Tshabalala and the like. Think Judge John Hlophe. A lawyer and a judge from a very young age. Someone who would have ascended to those heights thanks to affirmative action. He has been found to have been held on a retainer by a company which he later was to grant permission a sue a fellow judge. Thats a clear conflict of interest. He fought with the bar council of the Cape. He has been accused of uttering racist statements about people in the legal fraternity. He has been accused of trying to influence the outcome of a matter before the Constitutional Court affecting Jacob Zuma. Now, he is said to have told EFF lawyers that their matter against the parliament of South Africa will never be heard in his court. He is the president of the Western Cape Provincial Division of the High Court of South Africa. The senior most Judge in a division denying citizens of this country access to justice. A blatant flouting of the constitution of this country, not unlike urinating on the signed original copy of the constitution. What are black legal practitioners and judicial officers saying about this? I bet you wont hear even a groan from them. Theyll say saying anything would be career limiting and viewed as undermining the objectives of affirmative action by criticising an affirmative action beneficiary. To hell with the reputation, good name of and respect for their profession. Affirmative action has to be defended at all costs. Sies man!
