I need some advice, hoping someone on here may know the law better than me and can direct me before I go and get a lawyer. My situation: On June 19th, I was shopping at Stop & Shop in Allston MA and I slipped and fell pretty hard on some water on the floor where there were no caution sign. Long story short I wasnt going to say anything to the manager but then I continued shopping and almost slipped AGAIN on water in another isle. I spoke to the manager, she took down my information, I told her I was fine and all that but was concerned someone else might slip and really hurt themselves. Then I purchased my items and went home. Got home, noticed my phone was cracked. I called the store and they put me in contact with the Stop & Shop insurance company (Macrisk Management), and put in a claim. This was June 19th. I did a phone statement with a man, Wayne Buccini stating what had happened and all that. I have been calling Mr. Buccini every week since, and he is still waiting for the video. I work Loss Prevention... I know how easy it is to get a video. I am being given the run-around. Today I called, and he said he is still waiting on the video, but that he checked the store sweep log and said that the log states that an employee sweeped the supposed area I feel in 20 minutes prior, so basically, he is saying that they are not responsible for my fall because it is no fault of their own. So they will not pay to get my phone fixed as they are not in the phone fixing business in his words. HIGHLY UNPROFESSIONAL, trying to mock me. So even without the video he is saying that what happened to me IN STOP & SHOP, on THEIR property, is no fault of theirs and they are not responsible. So why the runaround about the video? I asked what if I was severely injured, he said that they still would not be responsible, so they wouldnt pay for any medical bills due. Then he is basically questioning what Im saying to be true, and saying that in the recording I said THEY HAD JUST MOPPED and didnt put the sign down. I DO NOT WORK FOR THEIR COMPANY, I do not know FOR CERTAIN if someone just mopped, but there was water all over the floor, and I slipped on it. TWICE. So because someone says they checked the area (which by the way was right next to the seafood section, where they display all the fish and water could easily leak from the displays.... or if a customer happened to spill enough water that I slipped on while walking past.... it is an area full of employees from the seafood section AND the deli section..... see where Im going here? Im being treated like Im lying by this man and I have been nothing but patient and professional. Im not asking for money. I just want what was damaged of mine, through no fault of my own, to be fixed. Thats all! What other steps can be taken? Because it seems this man has made up his mind without even having video yet and I AM THE VICTIM. Any advice before I contact a lawyer and waste more time and money on something that shouldnt have even happened?
