I received the email below from EANGUS: The Call 13-06: Protecting Guard and Reserve Pay During a Government Shutdown On October 1, 2013 at 12:01 a.m. the federal government officially shut down. However, just prior to the shutting down, Congress passed, and the President signed, H.R. 3210 – The Pay Our Military Act, which would pay the military and Department of Defense personnel throughout 2014 when other appropriated funds may not be in effect, such as a government shutdown. The Department of Defense is currently reviewing H.R. 3210 to determine whether they can bring back furloughed workers. However, by passing the Pay Our Military Act it was Congress’s intent that no DoD civilians, contractors, or military personnel should have been furloughed. In response to the narrow interpretation of the law by DoD, Congressman Howard “Buck” McKeon sent this letter to Secretary Hagel. The letter stated “the legislation provides you [DoD] broad latitude” in determining who should and he “strongly encourage[s] [DoD] to use the authority Congress has given you to keep national security running, rather than keeping defense civilians at home when they are authorized to work”. However, to further clarify the intent of H.R. 3210, Congressman Austin Scott has introduced H.R. 3241, the Pay Our Guardsmen and Civilian Defense Personnel Act. This legislation will amend H.R. 3210, to clarify and provide for continuing resolutions for defense personnel (including dual status military technicians) and members of the Reserve Components of the Armed Forces performing inactive-duty training. Because of the ongoing government shutdown, most congressional offices are not fully staffed and there will be a delay in reading and replying to email.
