I think were missing one key element in the Oscar trial. In a criminal case its the states job, through a public prosecutor to gather evidence to make a convincing case beyond reasonable doubt on the guilt of a person. There was no sufficient evidence( yes put your natural bias aside) to prove Oscar was guilty of murder(the intentional killing), hence the next competent charge with that evidence brought forth by the state was culpable homicide( the negligent killing), which he was found guilty of. Its not the judges job to investigate Oscar or prove his guilt, but rather to make a ruling on the evidence presented by both sides.If you want to debate the merits of the evidence, now that is a different story.
