I threw the BULLSHIT card several times this weekend on the idea that the makers of Red Bull Energy Drink had lost a lawsuit because a judge had ruled that their claim of Red Bull gives you wings constituted false advertising because it did not, in fact, produce wings upon those who consumed their product. People have been honestly upset because of the stupidity of the judge who allowed this stupid lawsuit get so far. I will stop short of saying that these upset people were stupid. The case was settled out of a judges courtroom. The complaint never mentioned the assumption of bestowed wings. The complaint did mention that Red Bull did not provide the consumer with energy, only increased alertness from the added caffeine. Here is the relevant quote from the lawsuit which Red Bull settled out of court: Even though there is a lack of genuine scientific support for a claim that Red Bull branded energy drinks provide any more benefit to a consumer than a cup of coffee, the Red Bull defendants persistently and pervasively market their product as a superior source of energy worthy of a premium price over a cup of coffee or other sources of caffeine. Such deceptive conduct and practices mean that [Red Bulls] advertising and marketing is not just puffery, but is instead deceptive and fraudulent and is therefore actionable. See? Just a description of deceptive advertising practices. No wings. I bring this up not because I wish to take the fun out of misplaced outrage, or to ridicule the easily misled. I just really like being right about calling BULLSHIT. I recommend you try it next time you hear something you cant believe is true. It can be a lot of fun when youre right.
