I too am a victim of the aggressively trained over officious paramilitary style police mentality used in the war on drug. July 8th 2005I was stopped on the street, forced to the ground, handcuffed, and beaten. Cracking my cheekbone and giving me nerve damage in my neck and wrists. After not finding anything illegal on my person nor having found any warrants or other justifiable reason for having done these things to me. The 2 sheriffs called a nearby undercover to the scene along the roadside on Ridgecrest. The undercover that arrived was a black Lieutenant who I had seen many many times in the area and whom I new to be a police officer before this whole event. He and the other two new boots officers then concocted a story to explain the stop and encounter and then planted cocaine in a baggie and labeled it with my name. Then put me in the car and drove me to the station. I didnt even find out what I was charged with until my arraignment. It wasnt until my 1st court date that I requested a copy of the police report and learned of this fraud and deceit. Later on down the road I missed a court date and so a warrant was issued. I was picked up and taken in. I then plead to a 6 month sentence because I could not afford a lawyer and the chances of me beating a trial, against 2 cops words with a public defender and no hard proof other than the photos of my injuries my girlfriend took 3 days later when I got out on bond, were nil to none. And even waiting for a trial meant as much as 1 year to 18 months in dallas county jail, whos conditions are atrocious. So it was faster and less painful to plead the 6 months of time they were dangling at me. I took it the time even though I didnt do the crime and was brutally assaulted in the process. I then got lost in the dallas county system because of a data entry error that prevented me from being released in to TDC custody for processing until my release date, which cant happen until i am processed by them. I was stuck and wasting away for nearly 3 months past my release date. I had to write all of the major news stations and newspapers in the area. The parole board, the judge, the court coordinator, my lawyer, the NAACP, everyone. Sent formal messages to every rank from sgt. on up through the system to the big dog Lupe Valdez. Several times. Nothing got done. Finally I had a guard print out my file in the dallas system and he gave it to me (not permitted by his job of course) I then found the error that was holding me up. Then a guard in the law library told me the name and address of the division within the sheriffs department that is responsible for actually entering the data and who would have been the ones that made the error that was preventing my processing from proceeding. It took TWO letters and 3 weeks after finding this out to get the hold released and the error corrected. I was processed for a separate hold 2 days later and transferred to that facility. So Again I understand the pain of being victimized by the system. I wish I wasnt broke or had had a way to speak out loudly enough at the time. I fear nothing will ever be done to bring any justice to that days events and outcomes. Lets hope this guy has better luck.
