I voted YES on HB 4622 and HB 4793, introduced by Rep. Pscholka (R-Stevensville). These bills amend the Drain Code of 1956 to allow for the revision of drainage district boundaries. These bills will authorize drain commissioners and drain boards to modernize drainage district boundaries within their jurisdiction, permitting much-needed updates as the land and scope of the districts has changed over the years. The revision of drainage districts allows drain commissioners to more accurately assess property owners that benefit from drainage systems. Many drainage district boundaries were established over a century ago, and have not been revised to accurately reflect changing drainage patterns due to land division and development. There is a provision for an appeals process for property owners aggrieved by a redistricting decision. There is also a requirement that district boundary revisions be based on the recommendations of a licensed surveyor or engineer. Finally, the bill package revises the condemnation process by striking procedures under the Drain Code and replaces it with language to utilize the procedures established under the Uniform Condemnation Procedures Act. Both bills passed with a vote of 106-0.
