I want to publicly address the Valentines show this previous weekend at Expo Idaho. Prior to the show, we sold booths to vendors. Some chose bigger booths, some chose smaller booths, and some chose to purchase multiple booths because they needed the room for their items. We not only advertised like crazy on facebook with multiple posts in groups and on personal pages as well as with an invite to the event, but I went above what the contract with these businesses promised and put out sign at the show (two 8 foot x 3 foot professionally printed banners), but also 8 other signs (yes, hand made on poster board displayed on metal sign holders) that stretched from the front gate of the show to the end of the sidewalk where the show took place. We advertised on the radio as we promised for the week prior to the show. We created two different online videos for our vendors to share as well on their pages and walls. We also hired a person to stand out for 6 hours in the snow/rain with a sign pointing people to the show. In my contract, I have the following wording about attendance and ATTENDANCE BY CONSUMERS-WE MAKE NO PROMISES TO THE NUMBER OF ATTENDEES AT ANY EVENT. WRITTEN, VERBAL OR OTHERWISE. ADVERTISING- WE MAKE NO PROMISED ABOUT ADVERTISING BEYOND FACEBOOK NOTIFICATIONS AND PROMOTION, CRAIGSLIST AND COMMUNITY CALENDARS. VENDORS ARE EXPECTED TO HELP ADVERTISE THE EVENTS AS PART OF HAVING LOWER FEES FOR OUR SHOWS. Any advertising we decide to do beyond the for mentioned methods are above and beyond anything promised in this contract. I will post my contract below so you can all see it. Its not secret. Its posted everywhere beforehand as well as embedded in the invoice through paypal that every vendor receives when they sign up for a show. Unfortunately, the weather was horrible the day of the event. It had snowed for two days prior to the event and snowed and rained the whole day of the event. Attendance at the Golf Show in the larger building was larger than our event and the boat show. That is because for the last couple of months, they have been preselling tickets. I was told they presold 1000 tickets to their show. The boat show does have an entry fee and did not sell tickets prior to the event and I am told that they had poor attendance as well. Our shows are always free. I feel its better to not charge an entry fee so that potential customers arent hindered by having to pay to enter a show. I did everything promised in my contract with my vendors...and more. There is a very small group of the vendors at this show that are upset because attendance was low. I dont like that it was low either. But...I cant make the weather be nice all the time, I cant go pull people into the show physically. All I can do is what I promised to do prior to and at the show...which I did. This small group of vendors is making a big noise and calling my character and business practices into question. I am addressing this issue publicly because I wont be bullied or scared into returning money for a show because they decide to make threatening posts, leave terrible messages or message the other vendors trying to cause a problem. I also wont apologize for trying to make a living. Ive told many of you that I never met for this to be a business but because of the hours and hours it takes to plan and execute a show, it has turned into more than a full time job. I would expect that anyone of you would not work for free 60 plus hours a week. Below is my contract. If you sign up for a show with me, please be assured that I absolutely work my butt off for you. Even though it is not in my contract to do so, I tried to work with most of the vendors that was at the Valentines show to give them the opportunity to be at another show and try to make up sales they didnt get at the Valentines show. I refuse to do this, however, with bullies. ______ Dewey Events Contract No refunds for any reason! By paying this invoice, you are agreeing to the following binding contract from Shanna Dewey Productions:The person signing this application above, requests to reserve a booth at a Dewey Productions Show. It is understood that the terms and conditions listed below are the conditions upon which this application will be accepted. This application is not valid until you receive confirmation it has been accepted and is subject to cancellation for any reason, as Dewey Productions reserves the right to reject any application. All displays are subject to final approval by the management. Payment Arrangements: If you have asked for and received payment arrangements, you must pay by the agreed to due date or you will loose your booth space and forfeit any deposit you paid. You will be reminded before the due date, but there are NO EXCEPTIONS to this part of the contract. No refunds no matter what the reason unless the show is cancelled by Dewey Events. SPACE – The space leased above will only be occupied by the business listed above. No signs, flyers, literature, brochures, products or any other materials from any other business will be displayed in the booth. No oral changes to this contract will be accepted. Dewey Productions reserves the right to demand payment for additional booth fees if their representatives find a business promoting products/services not listed in this contract at their discretion. CANCELLATION POLICY- We have a no cancellation policy/no refund policy. You will not receive any money back if you need to cancel for any reason. In the case of weather related cancellations or cancellations on our part for any other reason, you will be given credit for the amount paid toward a future event. Should you choose not to want to participate in a future event, you waive your right to a refund. EARLY MOVE OUT-If you choose to pack up earlier than the time stated for the show you are registering for, you can and probably will be charged a fine of $50 to the credit card we have on file. If an event needs to end early because of weather or other unseen circumstances, you will be notified by a staff member of Dewey Productions. Forms & Tax Information: You are responsible for any necessary forms, permits, and tax registration required for the show. If you do not complete it, you will not be allowed to set up your booth at the show. No exceptions. INSURANCE AND LIABILITY – Neither Dewey Productions nor the owner of the facility shall be responsible for loss or damage incurred by the exhibitor by any cause whatsoever. The exhibitor agrees to protect and save, harmless Dewey Productions and the owner of the facility, against any and all claims for loss, injury, or damage to persons or property arising from the activities of the exhibitor, his agents, employees or guests, defend Dewey Productions and the owner of the facility against any and all such claims to reimburse and indemnify Dewey Productions and the owner of the facility for any loss, damage, expense, or payment suffered thereby. We dont require liability insurance, but highly recommend it. MERCHANDISE REMOVAL – No exhibits or part of the exhibit may be removed until after the closing hours of the last day of the show. Upon the close of an event all the exhibitors shall remove all small and valuable items from their displays. All merchandise and display materials must be removed from the ground on the show date. ATTENDANCE BY CONSUMERS-WE MAKE NO PROMISES TO THE NUMBER OF ATTENDEES AT ANY EVENT. WRITTEN, VERBAL OR OTHERWISE. ADVERTISING- WE MAKE NO PROMISED ABOUT ADVERTISING BEYOND FACEBOOK NOTIFICATIONS AND PROMOTION, CRAIGSLIST AND COMMUNITY CALENDARS. VENDORS ARE EXPECTED TO HELP ADVERTISE THE EVENTS AS PART OF HAVING LOWER FEES FOR OUR SHOWS. Any advertising we decide to do beyond the for mentioned methods are above and beyond anything promised in this contract. LITIGATION – If a suit or action is filed regarding this contract, the exhibitor promises to pay Dewey Productions costs and reasonable attorney fees in such a manner as set by the court. ____________________________________________________________ Let me explain a few things about this contract that will be in full effect for this particular show: 1. If you do not pay for your booth by the times the invoices are due, you will be removed from the show. If you dont communicate with me, I will have to assume youve changed your mind and no longer want to do the show and are waiving any deposits you made. Period. 2. There are no refunds for any reason 3. I NEVER promise attendance 4. You, as a vendor, are responsible for helping advertise. Facebook, craigslist and adding people to the event invite page are all easy ways to help do this. Inviting people to the show on a personal level is even better. 5. IF YOU DO NOT FILL OUT THE REQUIRED FORMS, ESPECIALLY THE TAX FORM, YOU WILL NOT BE ALLOWED TO SET UP YOUR BOOTH, LIKE IT OR NOT. 6. Re: advertising Anything, including signs, banners, balloons, flags, hiring a sign person...is ABOVE AND BEYOND WHAT IS PROMISED IN THIS CONTRACT. If you are unhappy with those things, Im sorry. They are above and beyond what is promised in this contract.
