I was at the NSW State Archives last week and copied a legal case which was heard in 1845, it was our ancestor, Jack Congo Murrell against the British Crown. Jack Congo Murrell had murdered another Aboriginal man and then tried for murder under British law in Sydney. The matter was thrown out of Court because the British agreed that Aboriginal law existed before they (British) came to Australia and therefore the British Court system had no juristiction over the matter. Jack Congo Murrell was sent back to the Daruk tribe for punishment. This president in British/Australian law can never be overwritten unless we (the Aboriginal people of Australia) agree to it. I am not a lawyer but believe that this court case is as important as the Mabo case - where it was proven that traditional land title pre-existed prior to British law.
