I wonder why the Congress, as a collegial body, has not acted on the contract between the PH Gov’t and Water Concessionaires that has passed the burden of paying taxes to us, the CONSUMERS. It is well within the powers of Congress to conduct inquiry “in aid of legislation”. Accordingly, P15Billion worth of taxes were passed unto us, consumers, by these water concessionaires. The Constitutional provision - “No law impairing the obligation of contracts shall be passed”cannot in any way prevails, withstand, hold out or defies the Police Power of the State. I vehemently agree with Senator Miriam Santiago that Police Power is the mandate to “make all laws necessary and proper to preserve the public security, order, health, morality, justice, and general welfare.” But what is more surprising is, we have great lawyer-congressmen and lawyer-senators who perfectly knew the hierarchy of rights. The Constitution etched out the basic protection given to life, liberty and property. We, consumers, who have paid the taxes of these water concessionaires were indirectly robbed of our properties, our monies. And as Shylock said property has an intimate relation with life and liberty, he further stressed “You take my life, when you do take the means whereby I live.” And as John Adams said “property is as sacred as the laws of God, but to deny protection to property altogether is to invite both ANARCHY and TYRANNY. I salute Sen. Trillanes for his bravery, intrepidity and boldness to propose an inquiry in aid of legislation regarding this matter but sadly was supplanted by Sen. Enrile, who is a lawyer (who seemed to forget his Constitutional law expertness).
