I work in Legal right, so my interest was peaked when I heard that yesterday, our duly appointed Chief Justice Mogoeng Mogoeng said “If religion were part of the law-making process, the moral fiber of South African society would be better” – and - “The lack of religion in the country’s laws has directly resulted in evils such as crime and corruption that are currently plaguing society”. Professor Martin Prozesky: Independent Applied Ethic Consultant at Compass Ethics (an Emirtus Professor and Senior Researcher the University of the Free State said, among other comments, that “Moral goodness is not reliant nor dependent upon religion”. IN MY VIEW: Putting religion back into law, is the reverse of what all Democratic States have been doing since the Magna Carta (being when the first Bill of Rights was ever drawn up in England in the 14th Century)! We need a Secular State (being – one that is not governed by religion – but by our Constitution) – NOT - an Ecclesiastical State (being – one that is governed by religion)?! This suggestion he has made would end up having the Constitution of our country re-drawn! Some of us will recall having read about, or vaguely heard of, the Crusades in the 11th and 12th Centuries with dear old Richard the Lion Heart (and let’s not forget all the Henry’s), when the Roman Catholic Church (known as Christians) tried to ‘take back’ Jerusalem from Islam – both sides were governed by ‘religious laws then? What a bloodbath! Back too in those days, when Roman Catholic law prohibited divorce, King Henry VIII found it ‘inconvenient’ that he could not divorce his first wife Catherine, so he chucked the Roman Catholics out and established the Church of England. MY QUESTION IS: Who/How are they going to decide ‘which’ religion should be passed into law? Who/How are they going to determine ‘which’ the ‘right’ religion is – out of all the ones we have – what then will our ‘religious culture’ be? Imposing religion into law-making simply removes accountability to the Constitution and the Courts - for those in power! So ... I guess we may be one step closer to this One World Religion, enforced by law....
