This incident started before the introduction of the MLC, but that is no excuse for the unions, the Flag State and the seafarers national government not to put pressure on the ship owner. Presumably the ship owner has other ships operating that could be arrested to force the issue. No seaman should be treated in this way. Suri, AFNI Managing Director at Crewmatics Marine Pvt. Ltd. This particular incidence of abuse of seafarers in the middle of valid COEs brings out the holes in the Maritime Labour Convention. Standards have been implemented for Flag states, Port states and States of residence of seafarers. Yet, the Flag state (Singapore, ratified MLC on 15-Jun-2011) has failed, Port state (UAE/Dubai, no intention yet of ratifying the MLC) continues to obstruct seafarers from returning home unless arrangements are made by port agent, and port agent refuses to act because unpaid agency fees are not paid by Varun Shipping, as if seafarers are the owners assets which can be held by port of Dubai. And the State of seafarers residence is tied up in knots by loopholes in Indian merchant shipping law, which are exploited by the battery of lawyers (as well as political connections) at the owners disposal. As for ITF, they claimed lack of jurisdiction over the Indian flagged fleet, but this vessel is FOC flagged in Singapore and squarely in the line of action by SMOU and SOS, the ITF affiliated unions in Singapore, whose rate of contribution to seafarer welfare funds are the highest in the world! As Rob has stated the ship owner has other ships operating that could be arrested to force the issue But the question is who must force the issue, if non of the States charged with their specific responsibilities initiate the action. No regulation without teeth is worth the paper it is written on. IMO can go on piling up regulations and conventions, but without provision of penalties for the defaulting States, seafarers will continue to be vulnerable to rogue operators. If I remember right, earlier CDC were issued separately for Home Trade. If so, what is the control going to be exercised considering Safety & Security ? Would they be treated as non-seamen, while on coastal vessels? What about signing ON/Off on Coastal/Home Trade vessels? How are the record of service going to be maintained ? Eligibility Rules for employment on Coastal vessels? Requirements? Would it not add on more loopholes for bringing in administrative-lapses? This is certainly not a fool-proof system. This will add on many FUTURE - complications with administrative lapses in the future, on manipulations and loop-holes in the system. It appears and known from above-said message that Maritime Board takes the responsibility, instead of the office of D.G.S., which is ultimately responsible, being our National Shipping Administration. If to go ahead, please have this endorsed by the ex-mariner, involving Capt. PVK Mohan, who is the Chairman of the National Shipping Board. P.S. Holding life, as the most important aspect than anything else under Article 21 (Right to Life and liberty) of the seamen very close to my heart, who are out on the deep seas on occupational hazards, who really sacrifice their human-life for others, * i.e. their own family dependents, to their own country of origin, and supporting the world-trade etc. PARTICULARLY KEEPING IN MIND, THE PRECAUTIONARY PRINCIPLE, TO DIRECT AND PASS INTERIM ORDERS FOR THE IMMEDIATE REVOKE OF THE ORDERS, which is my humble submission.
