Id like to get more details about this incident. If the cop was in fact responding to a domestic disturbance call naming this address, he does not need a warrant to go knock on the door to ascertain the validity of the call. Once he reaches that point, its a judgement call, granted to him by us, by the way, as to whether or not reasonable suspicion or probable cause can be established for the call. He cannot, however, just start creeping around in the backyard, or trying to peek into windows. He has to knock on whatever door appears to be the main entrance, and when a resident opens the door, thats when the cop must use his senses, training, and experience to quickly evaluate the situation based on what he sees and hears through the open door. He can ask to see all residents to determine if one or more of them have been involved in an assault/battery/domestic abuse. He MAY NOT...AT ANY TIME, pull his taser or firearm, unless there is reason to believe that anyone (including a dog) at the residence means to cause him bodily harm FIRST (someone moves for a visible or suspected deadly weapon, makes a threatening gesture, or allows a pet to get too close with a threatening demeanor). The laws & regulations governing police behavior and procedures in these situations are very clear. Problem is, we are seeing a startling increase in cases where police overstep, abuse their authority, overreact, and even commot cold-blooded murder, and actually get away with it. I want cops to do their jobs, be safe, make it home after their shifts, and uphold the law, but Im also very disturbed at the trigger-happy, shoot first attitude many of them are displaying. We really need more info on this one.
