A friendly reminder (so I dont have to scream at you from my bicycle saddle): BICYCLES ARE NOT PEDESTRIANS: Pedestrian means any person afoot and any person operating a wheelchair or a motorized wheelchair or an electric personal assistive mobility device. I.C. 49-117(5) (legislature.idaho.gov/idstat/Title49/T49CH1SECT49-117.htm) BICYCLES ON THE ROADWAY SHOULD BE TREATED LIKE VEHICLES, NOT PEDESTRIANS: Every person operating a vehicle propelled by human power or riding a bicycle shall have all of the rights and all of the duties applicable to the driver of any other vehicle under the provisions of chapters 6 and 8 of this title, except as otherwise provided in this chapter and except as to those provisions which by their nature can have no application. I.C. 49-714(a) (legislature.idaho.gov/idstat/Title49/T49CH7SECT49-714.htm) A BICYCLE HAS THE RIGHT TO USE THE LANE / BICYCLES DO NOT HAVE TO RIDE ON THE SHOULDER: 49-717. Position on highway. (1) Any person operating a bicycle upon a roadway at less than the normal speed of traffic at the time and place and under the conditions then existing shall ride as close as practicable to the right-hand curb or edge of the ROADWAY except under any of the following situations: (a) When overtaking and passing another bicycle or vehicle proceeding in the same direction. (b) When preparing for a left turn at an intersection or into a private road or driveway. (c) When reasonably necessary to avoid conditions including fixed or moving objects, parked or moving vehicles, bicycles, pedestrians, animals, surface hazards or substandard width lanes that make it unsafe to continue along the right-hand curb or edge. (2) Any person operating a bicycle upon a one-way roadway with two (2) or more marked traffic lanes may ride as near the left-hand curb or edge of the ROADWAY as practicable. legislature.idaho.gov/idstat/Title49/T49CH7SECT49-717.htm Roadway means that portion of a highway improved, designed or ordinarily used for vehicular travel, EXCLUSIVE OF SIDEWALKS, SHOULDERS, BERMS and rights-of way. I.C. 49-119(19) (legislature.idaho.gov/idstat/Title49/T49CH1SECT49-119.htm) In other words, if there is a bicycle on the ROAD, treat that bicycle just like a MOTORCYCLE or any other vehicle: dont try to squeeze around it, dont try to force it onto the shoulder, for the love of GOD dont STOP for it when you have the right-of-way and it doesnt.
