If a court has no territorial jurisdiction to entertain the suit, the plaint shall be returned to be presented before a court having territorial jurisdiction to entertain the suit. In the same way , if the court has no pecuniary jurisdiction, the plaint shall be returned to be presented before a court having pecuniary jurisdiction to entertain the suit. But if the court lacks inherent jurisdiction to entertain a suit and the relief sought can be granted only by some other court or agency under law , then the suit shall have to be dismissed as a whole and plaint is not to be returned.
