If you’re like me, you are viewed by corporate America as an insignificant faceless speck of a consumer and the biggest cost of doing business with you is the risk of litigation. So how does corporate America get around that problem? Make all its customers agree to arbitration. Here’s how corporate America views your ability to sue them in today’s arbitration focused justice system: Want to sue us, well you can’t go to court. Still want to sue us, you have to share with us the costs for the arbitrator’s services (of course if you could go to court, which you can’t, you’d be getting the judge’s time for free, courtesy of taxpayers). Arbitrators are ex-judges and retired lawyers who demand $600+/hour for their services. Still not convinced, well we already picked the dispute resolution service company (didn’t read the contract, eh?) which will provide the arbitrator. You still want to sue? Just remember we do lots of business with the dispute resolution company (see any problem?) If the above isn’t enough, please know this dispute will be resolved according to the laws of a state far, far away from where you live and work–laws which favor us, not you. In conclusion: We’ve stacked the deck. Good luck achieving justice. Thanks for buying our unsafe and cheaply made products or injury producing incompetent services (there’s lots of profit margin), and have a nice day. So your choice is to (1) fight the arbitration clause in court; (2) if that doesn’t work (arbitration is favored by the courts), identify the right arbitrator for your case (they do exist); (3) hire an attorney that knows how to achieve 1 and 2 so that you have a fighting chance of prevailing.
