Im a little confused because I thought this was old news by now (perhaps it was just a threat before) -- but, either way, were depriving asylum seekers of access to legal representation. Self-representing litigants in AUSTRALIA who have a better understanding of our legal system and the language pretty much ALWAYS struggle. Imagine arriving in another country, totally traumatised and fearing for your life, only to find yourself having to work out how their legal system worked even though you dont speak the language? The law in this area is a mess and its not easy to prove refugee status -- there are all these tests you have to satisfy and steps to take. These asylum seekers probably do qualify for refugee status, but theyve made the status determination process harder over the years (which fudges with the statistics and makes it look like asylum seekers are only pretending to be refugees). I cant even imagine trying to appeal a decision on admin law (procedural fairness stuff) grounds without legal help.
