Im in need of a good vent session against NYS... 9 months ago an applicant came in looking for work. The shift manager interviewed and agreed to hire her. As she was leaving an employee approached me and warned me that this person was a known drug dealer. She knew the applicants name and where she was from so I had to give it some weight. I called the applicant that night and explained that something had come up and we wanted to look further into it before we officially hired her and let her work. She was asked if she had ever had any run ins with the law. She said no. I asked if she minded if I looked into the claims. She said she would like me to because she couldnt imagine what there could be. After entering her name in Google it came up with multiple arrests. I called her back and asked why she had lied to me. She cried and said it was long ago and she thought I wouldnt hire her if she told me she had shoplifted. One of the arrests listed was for failure to submit DNA after a prior arrest. That doesnt sound like a shoplifting charge. So I explained that had she been forthcoming with the truth we could have discussed the possibility of her working for me. However, since she had lied and wasted my time I did not trust her and wanted no future involvement with her. She said its illegal to not hire someone because they have a criminal record. I explained I am not hiring you because you LIED when I asked you a direct question. It has nothing to do with WHAT the question was. So she filed a complaint with NYS Dept of Human Rights. They are relatively new and trying to justify their budget so they pursued the complaint. I explained the situation. She was then subsequently arrested for trafficking narcotics. The same thing I was warned of. This was within weeks of her applying for the job. The State still decided to pursue the case. Then she was arrested again for assault, burglary, grand larceny in June of this year. I notified the Dept of Human Rights that there was no scenario under which I would ever allow this individual to work for my company. So today I had a conference call with the ALJ (Administrative Law Judge) and the States attorney. (She doesnt have to do anything, the STATE OF NY AND YOUR TAX MONEY PAYS FOR THIS!!!) Since she is in prison and unable to answer her requests to call in for this conference they had to do the only logical thing... schedule it for a hearing where I am required by law to bring a lawyer that I must pay for. Whether I win or not I can not seek restitution for my legal expenses. She meanwhile will incur NO costs. I asked the states attorney is there a policy from the state for future times when Im confronted with not wanting to hire a drug dealer? He said theres a multi point system in place that you have to meet if you wish to NOT hire anyone. Just knowing they may be a drug dealer isnt enough. I asked if there is someplace where I can get a copy of that system and he said he is not at liberty to tell me. So... Now I have to wait around even longer till they schedule a hearing that I have to go sit through to have this BS tossed out. Thank you all for paying for this piece of trashs legal fees while she is in a cell for beating up an old lady and stealing her purse. Like they say on a local news program... You paid for it.
