Im not sure what the distince is between being an employee of the Nebraska State Education Association and being the executive director of the Omaha Education Association, but Gov. Dave Heineman believes there is one. As a result, a court case is now looming so a judge can decide. To wit: A dispute about whether a teachers union employee can serve on the Nebraska State Board of Education appears headed for court. Secretary of State John Gale pledged Tuesday to pursue a legal action challenging Maureen Nickels’ qualifications for the seat. ...“It’s a novel issue,” Gale said. “It’s not easily resolved in her favor. It’s not easily resolved against her either.”...Gov. Dave Heineman raised concerns during last week’s canvassing board meeting about whether her position with the Nebraska State Education Association should disqualify her.... Nickels’ attorney, Scott Norby of Lincoln, argued in a letter to Gale that the constitutional requirement applies to people who are performing the duties of a teacher or an administrator ....Earlier this year, Heineman appointed John Witzel to the board, even though Witzel was on an Educational Service Unit board and was a member of the Nebraska and national school board associations. Two past state board members, Kathleen McCallister and Ann Mactier, remained on the Omaha Public Schools board while serving on the state board.
