In 2005, During military court trial in Attock fort on my son akhlas , he was shown as Pakistani citizen. Whereas, the documents which I have personally produced before the military court, which were included, Russian Passport, Pakistani visa, application for extension of visa in Pakistan, birth certificate, school certificate, receipt of the 740 dollars, which was issued by Pakistani embassy at Tashkent, clearly mentioned that Akhlas is Russian Citizen, not Pakistani once. I have sanded these dollars to H.E Major General (R) Fazal Ghafoor Ambassador of Pakistan at Tashkent and The Ambassador has given this money to my sons. Military court has rejected Russian Passport and all others documents as evidence and said that these are electronically generated and fake documents.Then, I have requested to military court to send these documents to Russian embassy for verification and authenticity of documents. But request was turn down without any reason. As per international laws and Geneva Convention Pakistan was bond to inform about arrest of any foreign citizen to concern embassy, to watch court proceeding, so that trial should be fair and transparent. Of course, military court did not want to expose the unlawful trial and contradictory to international law proceeding as well as Pakistani own constitution which forbid trial civilian in military court . Government of Pervez Musharraf and his colleagues have already breached Geneva Convention by not informing Russian Government; When Akhlas was arrested in 2003 by Pakistani agencies from Kotli so AJK. He was kept under military custody from 2003 to 2005 . As per Kashmir law Akhlas was state subject ,but not Pakistani citizen . Kashmiri on both side are not citizen of India and Pakistan .they used both countries passports as travelling documents. Civilize world might asked under what law; a civilian foreign citizen was kept under military custody for two years? Is Pakistan not banana state? In 2005, My wife and elder son, had applied for visa, to come Pakistan and visit akhlas in Jail, but, Pakistani embassy at Moscow has refused to give visas and told akhlas mother that akhlas is not her son. what a civilize reply to real mother ? It is very interesting that in Military court documents has been shown , ,Akhlas mother name Jamila, place of birth village Kukoota Poonch, school serh kukoota and he participated in Kashmiri Jihad from 1996 to 2001. Pakistan Foreign Office has provided this information to the Russian counterpart. So, Russian authority has checked all Afghan families living in Russia, but did not found any Jamila. Whereas Akhlas mother named is Svetlana Valentivna. He born in Volgograd city, He study in cerafimovish High school region Volgograd In 2007, Russian foreign office called Pakistani ambassador and strongly demanded for issue visa to Akhlas mother and brother. Then, after two years Pervez Musharraf Government has allowed Pakistani embassy to issue visa to family and then they had visited Pakistan and verified Russian authority that military court convicted Akhlas is her son. Since 2005, in all negotiations which has been taken place in in Moscow or in Islamabad, Russia side always raised the question of case of Akhlas nationality with Pakistani political leadership as well as Pakistani diplomats delegations, Pakistan side always promised to solve, but no action was taken by Pakistani side. Pakistani side knew that they have breached Geneva Convention /international law, if they would accept Russian position, then they have to release akhlas, which invisible forces did not want. Hana Rabani Khar has written a letter and move the case of release of Akhlas in her last period, so that improve the diplomatic relationship with Russia, but invisible force has created hurdles. Last year in September Mr.Sirtaj aziz special assistant to PM Pakistan has initiated the case of Akhlas and wrote to president to release him, for sake of improve relationship between Pakistan and Russia, but again same forces created hurdle, that is why letter which was written by Sirtaj Aziz is still lies in office of Minister of interior Ch.Nasir . In 2011, Pakistan has accepted Russian stance and recognize akhlas status as a Russian citizen, consular access was granted by ministry of Foreign affairs of Pakistan to Russian embassy. Many time Russian embassy representatives met with Akhlas in prison If, military court would have accepted the documents which I have produce before court , clear provide the evidences that akhlas is Russian citizen and was not in Pakistan, during that period, then whole trial would have to squish , which was not acceptable to General Musharraf and his regime. Secondly, in charge sheet, the main allegations were against Akhlas is “abet and seduce” armed forces personals, whereas punishment has been declared on Pervez Musharraf case. Please see the charge sheet, which I am going to paste; it will expose the whole military court proceeding. I have already sanded all documents to akhlas mother in Russia to raise akhlas case in international court of justice against Pakistan authority, which is going to prove that Pervez Musharraf and Ashfaque Pervez Kaini had created drama of attack and arrest some innocent persons and wanted to hang them in 2005 ,to show world their loyalty with their foreign masters . Anti terrorist court has already acquittal Akhlas from all allegations. Government of Pakistan has breached international laws and did not inform Russian embassy about arrest Akhlas , which was grass violation of diplomatic norms and international law. Friends are requested to study thoroughly the charge sheet and other relevant documents, and then decide themselves, about injustices, which has been done by military court with innocent akhlas and other. Inshahallah, this case will go in international court of Justices soon or later. If not, then I will wait the decision of Almighty Allah and asked justices for innocent akhlas.
