In February, the Federal Court of Appeal sided with Fiona Johnstone, an Ottawa woman who was denied a request to work three fixed 13-hour shifts as a Customs agent to accommodate her child care needs. Justice Leonard Mandamin upheld a 2010 ruling by the Canadian Human Rights Tribunal later challenged by the federal government. The ruling applies only to federal agencies but could extend to all employers in Canada if the case goes to the Supreme Court. Should employers be required to accommodate the family obligations of workers? Or should employees be solely responsible for finding ways to balance work and family?
