In Pakistan, It is more appropriate for the civilian Government to speed-up trial of terrorist cases pending in Criminal Courts and get early verdict of courts in said cases for implementation in accordance with civil and criminal law of pakistan.As military courts trial and pronouncement of judgments, are always subject to criticism by HUMAN RIGHTS ORGANIZATIONS even if the military-courts verdicts are passed on merits of the case. Secondly, ESTABLISHMENT OF MILITARY COURTS IN the presence of civilian Government, gives tinge of military intervention in government affairs which is not a desirable thing as our military is most needed in WAZIRISTAN and other troubled areas in Balochistan and KPK (PESHAWAR) where terrorists have ended writ of Government and created extreme lawlessness as is shown by ARMY SCHOOL tragedy where in 150 innocent school children were killed by terrorists. The foremost duty of Army is to defend the country and not to sit in military courts as a military-judge . AS MILITARY COMMANDER in the capacity of a prosecutor or judge , is neither acceptable in Pakistan nor recognized by international law ESPECIALLY WHEN COURTS- JURISDICTION IS STILL INTACT TO HOLD TRIAL OF TERRORISTS IN PAKISTAN . AS SUCH SETTING UP OF MILITARY COURTS SIDE BY SIDE CIVIL COURTS, WILL CREATE CONFUSION DUE TO CONFLICTING JUDGMENTS LIKELY TO BE PASSED BY BOTH THE COURTS. IT ALL SHOWS LACK OF JUDICIAL WISDOM ON THE PART OF CIVILIAN GOVERNMENT WHO HAS AGREED TO SET-UP MILITARY COURTS FOR TRIAL OF TERRORISTS IN PAKISTAN. (REVIEWED)
