In a 2-1 vote, 10th U.S. Circuit Court of Appeals panel upheld a lower-court ruling that struck down Utahs gay marriage ban.. In his dissent, Justice Paul J. Kelly Jr. said the 10th Circuit overstepped its authority and that states should be able to decide who can marry. Soooo.. if thats true, that means the state can decide that an atheist cant marry a Catholic; or that race has to marry like race? I dont see that being legal any more.
