In a no-fault divorce if both spouses consent to the divorce, there is a 90-day waiting period before the divorce can be granted. If the divorce is based on an irretrievable breakdown in the marriage, the spouse who files the complaint will have to show that the couple has lived apart for at least two years. If the couple has not lived separately for at least two years, the divorce will not be granted until the non-filing spouse agrees or until 2 years passes from the date of separation, whichever comes first. Keep in mind that even if you are separated and waiting for the 2 year period to expire or for your spouse to consent, you can still engage in negotiations regarding financial support and child custody.
