To my understanding, under current law (which, naturally, favors the employer) the employer has three years before a contract must be ratified. In the interim, the employer uses all manner of intimidation, threats, and propaganda to dissuade workers from choosing to organizing, including the disemployment of union proponents. Prior to the expiration of the three year limit, the employer holds another election and, lo and behold, the workers vote against organizing. The Free Choice Act was legislation designed to level the playing field for employers seeking to exploit workers, and workers seeking a voice in their workplace.
