In an unprecedented move, the Investigating Officer of Kamduni incident approached the Calcutta High Court for expeditious trial at Barasat Court. Admitting the case for hearing Justice Asim Kumar Roy has raised a vital question today, “ Whether the IO could move any such application ?” Senior Criminal Law Experts of the Calcutta High Court say, NO. They argue, According to the CrPC, the role of an IO comes to an end once the charge sheet is filed. In this instant case charge sheet is already filed. So the IO has got no interest left. Onus is on the Public Prosecutor of Barasat to arrange for a speedy trial. But he hasn’t approached the high court for that purpose. Some of the lawyers also argue that the investigation of Kamduni is still incomplete pending the SEROLOGY report from the Central Forensic & Science Laboratory. If the investigation is yet to be completed then what prompts the IO to make such a move before the High Court, they wondered. A section of lawyers claim that the Govt. is not comfortable with the Judge before whom the Kamduni case is pending and this could be a strategy to get the case shifted to some other court.
