Indiana HB 1017 HB 1017- Castle doctrine and vicarious liability, is another currently proposed piece of legislation we are supporting for IN. This bill is a relatively short, and simple addition to the Castle doctrine protecting one person from being held liable for another persons use of force. iga.in.gov/legislative/2014/bills/house/1017/# Defines a person as: An individual, employer, government entity, corporation, firm, trust, partnership, association existing under law, or a business. Adds that a person is not liable for loss or damage arising from another persons use of force if the other persons use of force is justified under IC 35-41-3-2 (Use of force to protect person or property). Except when the person is engaged in gross negligence or willful or wanton misconduct and the negligence or misconduct was the cause of the loss or damage.
