Sir, I am directed to refer to this department letter of even number dated 26-12-2013 on the subject cited above and to say that the matter was taken up with the Law Department. The Law Department opined as in the light of judgment of Honble High Court dated 9-12-2014 delivered by Ld.Division Bench in CWP No.6916 of 2011 alongwith connected LPAs and CWPs case titled as Pankaj Kumar Vs Stale of HP & others whereby the Honble Court by relying upon the law laid down by the Honble Apex Court, in catena of judgments, has dismissed the writ petition in question. Thus by the dismissal of the writ in question-i.e;CWP No.6916 of 2011, the interim order dated 18-10-2013 passed in CWP No.6916 of 2011-H is automatically vacated and as a result of it, the letter issued by this department dated 26-12-2013 is hereby withdrawn. You are, therefore, requested to comply the decision/orders conveyed by this department letter of even number dated 6J8-2013 after completing all codal formalities, under intimation to this department.
