Intellectual Property Theft Crimes – PROTECT UR ASSETS What is an Intellectual Property right? It is any discovery, invention or creation of mind for which exclusive rights are recognized by law. These commonly include the patents, copyright, trademarks etc. So one would ask what is the need to protect an intellectual property, the answer is quite simple, for the owners legal right to gain advantage from it and for the progress and wellbeing of the mankind. Types of IP Crimes: Historically there always has been theft of design to create fakes. Copying of software or illegal distribution of it, fake products, unlawful distribution of movies and music etc constitutes a major chunk of these crimes. Generally called piracy or counterfeiting, have gained an edge due to easy availability of high speed internet, which can be used to download bigger and larger software. Why is it on the rise? Factors that contribute to its growth are lack of strong legal penalties, widespread availability of technology and spread of Internet with no geographical boundaries and no or very little International Treaties to safeguard the interests of the victim. Are we doing enough? Intellectual property crime is an epidemic which has led to the loss of crores of rupees in India as well as in foreign countries. Whether these crimes are committed at the street corner or in the cyber world, they remain a nuisance. These call for stricter laws to stop these crimes from being committed. There are a few steps being taken to reduce the crime, like the recent judgement of US court banning the famous megaupload. Closer home in March 2012, in Thiruvananthapuram, 2 students were caught for piracy, they used to rip brand new movies and upload it on the internet on sites which allowed such activities. Yet, these counter measures are not enough. What needs to be done? We need to spread the awareness to protect IP rights by first registering them and then being proactive in protecting it by using several technological measures. Interested.
